Overview
Three Goats Gruff Trekking LLC (“Three Goats Gruff Trekking,” “we,” “us,” or “our”) organizes trail maps, trailhead transportation, and accommodation procurement for self-guided hikers within the United States. We are a Minnesota-registered limited liability company. By accessing our website or using our services, you agree to be bound by the following Terms & Conditions. Participation in any trip is also subject to acceptance of a separate Liability Waiver and Release Agreement, which must be executed prior to participation and is incorporated herein by reference.
Booking and Payment
All bookings must be completed through our website at www.threegoatsgrufftrekking.com. Questions may be directed to threegoatsgrufftrekking@gmail.com.
A deposit of $600 per room is required at the time of booking. If we are unable to fulfill your booking requirements, the full $600 deposit will be refunded. Once your booking is confirmed, $150 of the deposit becomes non-refundable.
We use the Swipe online payment system and accept payments via U.S. bank transfer, major credit cards (Visa, Mastercard, Discover, American Express), Google Pay, Apple Pay, Afterpay, PayPal, and other supported methods.
Upon receipt of your completed booking form and deposit, we will issue a booking acknowledgment and an invoice for the remaining balance. The balance is due 60 days prior to your arrival date, as stated on your invoice. If the balance is not paid by the due date, we reserve the right to cancel your booking, retain the deposit, and apply a late payment fee of $50 per person to cover administrative costs.
Cancellation Policy
If you or any member of your party must cancel a booking, written notice is required. The cancellation will take effect on the date written notice is received by our office. Refunds will be issued less the following charges:
· 30 days or more prior to arrival: $150 booking fee
· 14–29 days prior to arrival: $150 booking fee plus 50% of total trip costs
· 14 days or fewer prior to arrival, or after the trip has begun: No refund
These cancellation charges apply in all circumstances. We strongly recommend purchasing appropriate travel insurance.
Trip Pricing Fluctuations
Three Goats Gruff Trekking reserves the right to adjust trip prices listed on our website at any time prior to booking. You will be informed of the current price before confirming your reservation. Price changes may occur due to factors including, but not limited to, supplier cost changes or currency fluctuations.
Once your trip price has been confirmed in the Trip Acknowledgement following submission of your booking form, and subject to correction of errors, prices will not change unless modifications are made to the services included in your booking by you or by us.
Trip Alteration or Cancellation; Force Majeure
a. Alteration or Cancellation
While uncommon, Three Goats Gruff Trekking reserves the right, at its sole discretion, to alter or cancel any aspect of a trip. Most changes are minor (such as a change in accommodations or suppliers), and you will be notified accordingly. In the event of a material change, we will notify you as soon as reasonably possible.
b. Force Majeure
Three Goats Gruff Trekking may alter, suspend, or cancel a trip before or after its start date due to events beyond our control (“force majeure”). These events include, but are not limited to: acts of God; war or terrorism; civil unrest or emergency; economic collapse; governmental laws, regulations, or actions (including travel restrictions); natural disasters such as floods or fires; industrial or biological disasters; and public health threats including disease outbreaks, epidemics, or pandemics (including, but not limited to, the current or future impacts of COVID-19).
Such events may make performance impracticable or impossible or frustrate the purpose of the trip. If we determine, in our sole discretion, that performance is not possible due to force majeure, our standard refund and cancellation policies will not apply, and no refunds will be issued unless we determine otherwise at our sole discretion. In these circumstances, Three Goats Gruff Trekking will not be considered in breach of these Terms and will not be legally liable for any losses, costs, or damages incurred by you or any participant in your booking party.
c. Additional Costs or Damages
Regardless of whether a refund is issued, Three Goats Gruff Trekking is not responsible for any indirect, incidental, consequential, or other costs or damages incurred as a result of trip alteration or cancellation, including but not limited to non-refundable airfare, travel fees, or change penalties.
Our Responsibility
Three Goats Gruff Trekking is not responsible for any loss, delay, injury, or additional expense resulting from circumstances beyond our control, including but not limited to accidents, transportation delays or cancellations (public or private), weather conditions, illness, or labor actions. Any such losses or expenses are the sole responsibility of the client.
We reserve the right, at our sole discretion, to cancel a trip or modify any aspect of an itinerary if conditions or circumstances require.
Your Responsibilities
You are responsible for ensuring that you are physically fit, properly equipped, adequately experienced, and fully aware of the risks associated with your trip. While we take reasonable steps to promote safety, ultimate responsibility for personal safety rests solely with you.
You agree to follow all guidance provided in route notes or guidebooks, comply with instructions given by any representatives acting on our behalf, heed posted warnings or advisories, and adhere to all applicable federal, state, county, public land, and park rules and regulations.
Any damage caused by group members to accommodations is the responsibility of the group. Damage caused by solo travelers is their sole responsibility. Three Goats Gruff Trekking accepts no liability for such damage.
We are not responsible for normal wear and tear to equipment you supply. You accept responsibility for any breakage or failure of your equipment, even if it prevents you from completing your trip. While we will make reasonable efforts to assist with repairs or replacements, all associated costs are your responsibility, and no refunds will be issued for trips interrupted due to equipment failure.
Limitation of Liability
To the fullest extent permitted by law, and to the extent not otherwise released in the Liability Waiver, Three Goats Gruff Trekking, its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of our website or participation in any trip, including but not limited to loss of enjoyment, lost time, or personal inconvenience.
In no event shall the total liability of Three Goats Gruff Trekking for any claim arising from or related to a trip or these Terms & Conditions exceed the total amount paid by you to Three Goats Gruff Trekking for the applicable trip.
Self-Guided Nature of Trips; No Supervision
All trips organized by Three Goats Gruff Trekking are self-guided. Three Goats Gruff Trekking does not provide guides, instructors, trip leaders, or on-trail supervision. We do not monitor participants’ locations, decisions, pace, route choices, or daily progress during a trip.
You are solely responsible for navigation, route finding, daily decision-making, compliance with all posted warnings and regulations, and determining whether conditions are safe to proceed. You acknowledge that no rescue, emergency response, or on-trail assistance is provided by Three Goats Gruff Trekking. Three Goats Gruff Trekking does not provide medical, safety, or emergency response services.
Assumption of Risk
Participation in self-guided hiking and trekking activities involves inherent and unavoidable risks, including but not limited to uneven or unstable terrain, steep ascents and descents, falling rocks, changing weather conditions, wildlife encounters, water crossings, physical exertion, fatigue, remoteness from emergency medical care, and the actions or inactions of other participants or third parties.
By booking a trip with Three Goats Gruff Trekking, you acknowledge that you understand the nature of these risks and voluntarily assume full responsibility for all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in a self-guided hiking trip.
Third-Party Suppliers and Services
Three Goats Gruff Trekking acts solely as a coordinator and arranger of services provided by independent third parties, including but not limited to accommodations, transportation providers, luggage transfer services, and other suppliers. These third-party providers are not agents, employees, or partners of Three Goats Gruff Trekking.
We do not own, operate, or control any third-party supplier and are not responsible or liable for their acts or omissions, including but not limited to delays, cancellations, service failures, accidents, injuries, property damage, or changes to services provided. Any claims or disputes relating to third-party services must be pursued directly with the applicable provider.
Luggage Transfers
Three Goats Gruff Trekking accepts no liability for loss of or damage to luggage or its contents during transportation. You are responsible for packing your bags securely and ensuring that they do not contain valuables or fragile items, including but not limited to laptops, tablets, cameras, mobile phones, or glass items. Your luggage and contents must be covered by appropriate insurance.
Each customer is entitled to one bag as standard. Additional bags may be transported for an additional fee.
Complaints and Problems
If you experience a problem or wish to make a complaint during your trip, you must contact our office immediately to allow us the opportunity to resolve the issue at the time. If the matter cannot be resolved during your trip, you must submit a written complaint with full details within 14 days of the conclusion of your holiday. Complaints received after this period may be difficult or impossible to investigate.
Privacy and Use of Content
We treat your personal data with care and take reasonable steps to keep it secure. We do not sell your personal information and will request your consent before sending marketing communications. For additional information, please refer to our Privacy Policy.
By submitting any content to Three Goats Gruff Trekking (including text, photographs, graphics, video, or audio), you grant us a royalty-free, unrestricted license to use, modify, adapt, and publish such material for operational, editorial, or promotional purposes. Feedback may be used to improve our services and shared as testimonials with approved third-party review partners.
Data Storage and Processing
We store and process your data in accordance with the contractual relationship formed when you make a booking. Your information is used to process bookings, deliver services, send trip details, enable website functionality (including booking history, member access, and loyalty discounts), and contact you in the event of urgent issues.
We retain personal data only for as long as necessary to fulfill these purposes.
Governing Law and Jurisdiction
These Terms & Conditions, and any dispute, claim, or cause of action arising out of or relating to your use of our website or services, shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located within the State of Minnesota, and you hereby consent to the personal jurisdiction and venue of such courts.
Severability
If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms & Conditions, together with the Liability Waiver and Privacy Policy, constitute the entire agreement between you and Three Goats Gruff Trekking regarding your participation and supersede any prior communications or representations.
